Democrat House Speaker Nancy Pelosi used gilded ceremonial pens during her "somber" signing of the impeachment articles. Pelosi had promised not to celebrate but smiled and laughed as she awarded the pens to her Democrat colleagues.

Even CNN described the incident as "jarring" and "unusual."

Bernie Sanders would repeal the Tax Cuts and Jobs Act in order to pay for some of his pricey policy proposals, according to a report from CNN:

Other Sanders proposals, such as applying the Social Security payroll tax to annual incomes over $250,000, rescinding the Trump tax cuts and imposing an array of other new taxes on corporations, might collect another $4 trillion over 10 years."

A Sanders promise to repeal the tax cuts is a promise to raise taxes. If the tax cuts were repealed:

  • A family of four earning the median income of $73,000 would see a $2,000 tax increase.

  • A single parent (with one child) making $41,000 would see a $1,300 tax increase.

  • Millions of low and middle-income households would be stuck paying the Obamacare individual mandate tax.

  • Utility bills would go up in all 50 states as a direct result of the corporate income tax increase.  

  • Small employers will face a tax increase due to the repeal of the 20% deduction for small business income.

  • The USA would have the highest corporate income tax rate in the developed world, higher than the United Kingdom (19 percent), China (25 percent), Canada (26.8 percent), and Ireland (12.5 percent). 

  • Taxes would rise in every state and every congressional district.

  • The Death Tax would ensnare more families and businesses.

  • The AMT would snap back to hit millions of households.

  • Millions of households would see their child tax credit cut in half.

  • Millions of households would see their standard deduction cut in half, adding to their tax complexity as they are forced to itemize their deductions and deal with the shoebox full of receipts on top of the refrigerator.

In Vermont, where Sanders is a U.S. Senator, households who made the state average income of $61,438, received a tax cut of around $1,471, according to a recent Tax Foundation report.

Elizabeth Warren lied during the CNN/Des Moines Register Democrat debate on Tuesday night when she promised that her Medicare for All plan would not raise middle class taxes by “one thin dime.”

My approach to this is that we have to get as much help to as many people as quickly as possible. I have worked out a plan where we can do that by not raising taxes on middle class families by one thin dime.”

This is a lie, and Warren knows it.

Her Medicare for All plan repeals the Tax Cuts and Jobs Act, which would undoubtedly raise taxes on the middle class:

-A family of four earning the median income of $73,000 would be stuck paying $2,000 more in taxes each and every year.

-A single parent with one child making $41,000 would pay $1,300 more in taxes each and every year.

Every single leading Democrat presidential candidate agrees: Warren’s Medicare for All Plan will raise middle class taxes.

Even Bernie Sanders, the “author of the damn bill,” as he likes to say, admits that middle class taxes will have to be raised in order to fund Medicare for All.

Tonight during the CNN debate Joe Biden told Bernie Sanders that his tax to fund Medicare for All “doesn’t even come close” to paying for the over $40 trillion healthcare plan.

Here’s the key exchange:

Brianne Pfannenstiel: “Vice President Biden, does Senator Sanders owe voters a pricetag on his healthcare plan?” 

Biden: “We need to be candid with voters, I think we have to tell them what we’re going to do and what it will cost. A 4% tax on income over $24,000 doesn't even come close to paying for between $30 and some estimates $40 trillion over ten years. That’s doubling the entire federal budget a year.” 

Biden has previously said that “you’re going to have to raise taxes on the middle class.”

At one point, he even said that the plan is “totally unrealistic and can’t be done.”

To pay for the Medicare for All plan, Sanders has proposed a 4% tax on all income over $23,000, which Biden was referring to. 

Meanwhile Warren has proposed repealing the Tax Cuts and Jobs Act as part of her Medicare for All scheme, which would substantially raise middle class taxes.

Statement from Americans for Tax Reform President Grover Norquist on recommendations released today by the Michigan Joint Task Force on Jail and Pretrial Incarceration:

“The task force recommendations released today are a huge step toward creating the more effective, efficient, and affordable criminal justice system Michigan communities and taxpayers deserve. Too many people are being put in jail, and staying there for too long, for bad reasons. This makes the state less safe, and the system more expensive. The task force proposals address the problem by focusing on addiction, mental health, just and speedy trials, and not ruining peoples’ lives when they commit a minor offense. Tonight in Des Moines, the Democratic candidates will trash the Trump tax cuts. However, listed below are examples of how the tax cuts are helping Iowa households and businesses: 

Doubled child tax credit: 243,620 Iowa households are benefiting from the TCJA’s doubling of the child tax credit. The Trump tax cuts doubled the child tax credit from $1,000 per child to $2,000 per child.

Standard deduction: 1,008,940 Iowa households are benefiting from the TCJA’s doubling of the standard deduction. The Trump tax cuts doubled the standard deduction from $6,000 to $12,000 for individuals, and from $12,000 to $24,000 for married couples. Thanks to the Trump tax cuts, nine out of ten households now take the standard deduction which reduces their tax burden and simplifies the tax filing process.

Obamacare individual mandate tax relief: 38,430 Iowa households are benefiting from the TCJA’s elimination of the Obamacare individual mandate tax. Most households hit with this tax made less than $50,000 per year.

Tax cut: Every income group in every Iowa congressional district saw a tax cut.

Lower utility bills: As a direct result of the TCJA’s corporate rate cut, Iowa residents are paying lower utility bills. Lower electric, water, and gas bills help households each month, and also help small businesses operating on slim profit margins. Iowa examples of utilities passing on tax savings to customers include – but are not limited to Global Water Services, Iowa American Water Co., and MidAmerican Energy Company.

Thanks to the TCJA’s corporate tax rate cut – from 35 percent to 21 percent – and the TCJA’s 20 percent tax cut for small businesses, employers of all sizes are hiring, expanding, increasing pay and benefits, and paying special tax-cut bonuses:

Geetings, Inc. (Pella, Iowa) -- Was able to purchase new semitrailers and give employees raises because of the Tax Cuts and Jobs Act.

When small business owners anticipated how much they would save in taxes under the federal Tax Cuts and Jobs Act, many reinvested those savings in their businesses and their employees.

Anfinson Farm Store (Cushing, Iowa) -- $1,000 bonuses and 5% pay raises for employees:

Anfinson Farm Store, a family business in Cushing, Iowa (population 223), has awarded $1,000 bonuses and raised wages 5% for all full-time employees as a result of tax reform. The good news was delivered to employees in person just after Christmas.

In an interview with Americans for Tax Reform, store owner John Anfinson said tax reform will boost “money that will be available for the business overall and I want to use it in the right places.”

Anfinson has helmed the store for about 45 years. His grandfather started the business as a general store in 1918, so they will soon celebrate 100 years of operation. His customers chiefly grow corn, soybeans, and alfalfa.

“For us, we have a small number of employees. I work every day shoulder to shoulder with everyone,” said Anfinson. “When you work every day with a group of people, you know them and their family and you appreciate everything they do. Mowbility Sales & Service (Pella, Iowa) – The owner said that she was able to save around $40,000 from the tax bill, which allowed her to give employees raises and purchase new semitrailers:

Lana Pol’s small businesses are enjoying big savings under the new tax law — at least for now.

The entrepreneur runs four small companies across Iowa, including Mowbility Sales & Service, which sells agricultural equipment, and Geetings Inc., a trucking and warehousing business. Pol said she saw a drop in her overall tax burden this year thanks to the qualified business deduction, a change made to the individual tax code, available for pass-through entities. Her savings look substantial.

“We’re estimating around up to $40,000,” Pol said. “By utilizing that, we gave our employees raises, knowing that was going to help us for taxes this year.”

Pol said she also utilized Section 179 expensing to write off a major purchase of new semitrailers — six in all, totaling $1 million. Taxes were often a top issue prior to reform, she said.  March 18, 2017, CNBC article.

Keg Creek Brewing (Glenwood, Iowa) - Expanding operations, purchasing new equipment:

Mississippi River Distilling Co. (Le Claire, Iowa) – The owners of the distillery said that the Tax Cuts and Jobs Act helped create new jobs:

Both Quint and Ryan Burchett, co-owner of Mississippi River Distilling Co. in Le Claire, said the tax cut — formally called the Craft Beverage Modernization and Tax Reform Act — has helped their businesses add full- and part-time jobs. 

Cedar Ridge currently has 24 full-time and 28 part-time employees and, Quint said, now that he’s “optimistic” the liquor tax cut will be extended, he plans to make two new job offers over the next two weeks.

Burchett said Mississippi River Distilling had three full-time and five part-time employees in 2017, before Congress approved the liquor tax cut as part of the broader Tax Cuts and Jobs Act– Dec. 18, 2019, The Gazette article.

Dyersville Die Cast (Dyersville, Iowa) - $200 bonus for all eligible full-time employees; $50 monthly bonus for at least twelve months for all eligible full-time employees; $150,000 in total on bonuses:

“Dyersville Die Cast employees will be getting bonuses thanks to the recently passed tax reform bill.

Full-time employees who were with the company prior to Oct. 1, 2017 will receive a $200 bonus on March 9. But, that’s not all.

All full-time, hourly employees will also be receiving $50 monthly bonuses for at least the next 12 months.

In addition, employees will still receive their regular “profit bonus” in June, according to General Manager Bob Willets.

We told him about the high costs of over-taxation and over-regulation. He listened. He did his part, taking our message back to Washington. He fought for real tax reform that will bring our business taxes in line with other industrialized countries. More importantly it will mean more take home pay for our people. Tonight President Trump is hosting a rally in Milwaukee. Wisconsin residents are raking in the benefits of the Tax Cuts and Jobs Act, signed into law by Trump:

Doubled child tax credit: 424,970 Wisconsin households are benefiting from the TCJA’s doubling of the child tax credit. The Trump tax cuts doubled the child tax credit from $1,000 per child to $2,000 per child.

Doubled standard deduction: 1,954,190 Wisconsin households are benefiting from the TCJA’s doubling of the standard deduction. The Trump tax cuts doubled the standard deduction from $6,000 to $12,000 for individuals, and from $12,000 to $24,000 for married couples. Thanks to the Trump tax cuts, nine out of ten households now take the standard deduction which reduces their tax burden and simplifies the tax filing process.

For example, as a direct result of the tax cuts, full-time employees at the Pewaukee-based Trico Corporation will receive $650 bonuses and increased contributions into their 401(k) accounts. Brian's Electric (Stratford, Wisconsin) – The Tax Cuts and Jobs Act allowed the company to increase wages:

Jacobs told Budget & Tax News he has passed the benefits of TCJA along to his employees,

“I gave out, when you add it all up, about $150 an hour worth of wage increases,” Jacobs said. “Depending on how they have their taxes taken out of their checks, the lowest was around $14 a week in net take home pay, all the way up to $65 in net take home pay.” – Sept. 12, 2018, Heartland Institute article.

Koehler Flooring, Inc. (Green Bay, Wisconsin) – This family carpet and flooring company gave $1,000 bonuses to seven full-time employees:

There is more work to be done on the tax code but it's nice to see this recent reversal on punishing success. Sprecher Brewing Company (Milwaukee, Wisconsin) – The brewery used savings from the Tax Cuts and Jobs Act to reinvest in the company and create new jobs:

"Other breweries in this area are certainly doing the same thing with the savings they get as we are here," said Jeff Hamilton, president ofSprecher Brewing Company. "This act gave a bit of a tax break to all alcohol producers."

Right now, the team at Sprecher said the money saved from the tax breaks goes back into the business.

"Gives us additional funds that can be reinvested back into the company," Hamilton said. "Back into creating additional products, which on top of that creates new jobs." – Oct. 9, 2019, Fox 9 article.

Associated Bank (Green Bay, Wisconsin) – $500 employee bonuses (exact number receiving bonus unknown at this time); base wage will rise from $10 to $15 per hour:

Associated Bank today announced plans to raise its minimum hourly wage from $10 to $15 per hour and to distribute a one-time bonus of $500 for all hourly, non-commissioned employees once tax reform legislation is signed into law.

The pay increase and one-time bonus are expected to be distributed during the first pay cycle of 2018. This combined investment in the company's workforce will positively impact 55% of its employees.

"Every day our customers share stories of our colleagues delivering a positive customer experience," said Associated Bank President and CEO, Philip B. Flynn. "Our ability to recognize their work in this way is something we are proud to do."

Flynn said the new tax legislation, particularly the reduction in business tax rates, allowed the company to share some of the benefits with its employees. Central Standard Distillery (Milwaukee, Wisconsin) – The Tax Cuts and Jobs Act allowed the distillery to hire four new employees, invest in a new facility, and ordered a new bottling line:

Central Standard Distillery co-owner Evan Hughes said his business was able to grow faster than it normally would because of the act. He attributes four key growth areas to the success of the act, including: Central Standard hired four new employees, bringing staff totals to 22 people. The company invested in a 15,000-square-foot facility on Clybourn Street. In addition, Central Standard ordered a new bottling line for improved efficiency and offered health care to all of its employees.

Elizabeth Warren's Anti-Vaping Extremism Ignores Benefit of Vaping for Adult Smokers

Elizabeth Warren, responding to a voter question about vaping during a town hall on Sunday in Marshalltown, Iowa, agreed that she is perhaps the harshest candidate when it comes to the existence of the vapor industry, and signaled that she would crack down on legal nicotine vaping if elected.

Here’s the key exchange:

Voter: “Of all the 2020 candidates running for the Democratic nomination, you have come out with some of the harshest proposals to regulate the vapor industry.”

Warren: [Nodding] “Mhm.”

Voter: “If your proposals were enacted, it would shut down thousands of small businesses and eliminate over 95% of the products on the market today. What message do you have for adults like myself who rely on these products to live a smoke free life and are concerned that a vote for you would be a vote that would send me back to smoking and eventually my death?”

Warren: “Okay. So let me say the same thing I said earlier when we're talking about climate. I believe in science. I believe that the decisions we should be making about our health should not be decisions that are influenced by an industry. They should not be decisions, decisions that are influenced by lobbyists. I just want to do what's right here. And I want to protect our Food and Drug Administration to be able to do that. I read the argument and seen some of the data that suggests there are uses for vaping that may be safe and healthy. I, I haven't read all of the data on it. But like I said, I believe in science, I have also seen the risks that vaping poses to young people and to non smokers who are pulled in and what that means for their lives. So I just I want a rule that is based in science. I want a rule that is based in the best interests of the health of the people of the United States of America.”

It's not clear what "rule" Senator Warren is referencing, given the fact that the "Deeming Rule" which retroactively began to regulate the vaping industry was finalized in 2016 and subsequent decisions by the FDA have been issued via industry guidance that further limits the availability of these products, even for adults. Refusing to acknowledge the settled conclusion that vaping is a net benefit to adult smokers and posturing to suggest that further rules may be necessary indicate her lack of serious consideration of the subject. In fact, she recently joined other Senate Democrats in urging the Trump administration to ban all flavored nicotine vaoir products, product that are overwhelmingly used by millions of adults to transition away from cigarettes. Sen. Warren opposes anything that does not look like full scale prohibition. 

Last week Joe Biden suggested that he would “eliminate” vaping if elected.

I don't care what it does to a small business person who's selling this stuff. If it is damaging lungs, if it's causing the kind of damage that is said and that studies not been fully done yet. If it turns out that it is that I would eliminate it,” Biden said.


Lawsuits Continue to Pile Up Against California Nanny State Law

It has been a rough start for California Assembly Bill 5 (AB5). Although it has only been in effect since January 1, the controversial law has already been the subject of several lawsuits, as well as two court rulings unfavorable to the bill and its advocates.

In December, a lawsuit was filed by the American Society of Journalists and Authors (ASJA) in conjunction with the National Press Photographers Association (NPPA). They argue that AB5 is unconstitutional under the First and Fourteenth Amendment, meaning that the law fundamentally mishandles issues of free speech and equal protection under the law.

Uber and Postmates filed another legal challenge a few days later. They argue that “AB5 violates several constitutional rights including the equal protection and due process clauses of the Fourteenth Amendment, the Ninth Amendment, and the contracts clause of Article I.”

The California Trucking Association (CTA), which filed its lawsuit back in November, had yet another point of contention with AB5, arguing that it “violates the U.S. Constitution’s Supremacy Clause, which makes federal law the supreme law of the land. As the complaint explains, AB5 violates federal prohibitions on state laws.” Essentially, the CTA argued that specific provisions of AB5 are preempted by the Federal Aviation Administration Authorization Act of 1994.

The Harbor Trucking Association is also a plaintiff in the suit filed by the CTA.

In response to the CTA’s suit, on December 31, U.S. District Judge Roger Benitez issued a temporary restraining order preventing AB5 from being enforced “against any motor carrier in California, pending a final resolution of the lawsuit brought by the CTA.” A hearing on Judge Benitez’s ruling is scheduled for January 13.

Some media reports, including the San Francisco Chronicle, have portrayed this injunction as a minor bump in the road for AB5 and something likely to be overturned on appeal. However, the language used by Judge Benitez in his ruling indicates that the preemption argument has merit. In fact, Judge Benitez wrote, “the Court is persuaded by the likelihood of Plaintiffs’ success on the FAAAA preemption ground.”

Shortly after Judge Benitez issued the temporary restraining order, AB5 suffered another blow in court, this time at the state level. On Wednesday, January 8, Judge William F. Highberger of the Los Angeles Superior Court issued a ruling echoing the one issued by Judge Benitez. According to Judge Highberger, “an independent contractor/employee test required by the new state law, known as Assembly Bill 5, is preempted by the Federal Aviation Administration Authorization Act of 1994.”

So, where do we stand? After only being in effect for 10 days, AB5 has been the subject of multiple lawsuits, brought by a diverse array of plaintiffs. Court rulings at the state and federal level have indicated that the law is unconstitutional, while additional lawsuits are likely in the near future.

Pete Buttigieg released his $1 trillion “infrastructure“ plan on Friday, which calls for the repeal of the entire Tax Cuts and Jobs Act. The Buttigieg plan also raises the capital gains tax and imposes a 65% Death Tax.

As reported by CNBC:

His campaign said the plan will be paid for by reforming the capital gains tax and repealing the 2017 GOP tax overhaul, reforms that had been previously disclosed. The campaign will also raise the estate tax, with a top rate of 65% for billionaires.

Buttigieg’s promise to repeal the tax cuts is a promise to raise taxes. If the tax cuts were repealed:

  • A family of four earning the median income of $73,000 would see a$2,000 tax increase.
  • A single parent (with one child) making $41,000 would see a $1,300 tax increase.
  • Millions of low and middle-income households would be stuck paying the Obamacare individual mandate tax.
  • Utility bills would go up in all 50 states as a direct result of the corporate income tax increase.  
  • Small employers will face a tax increase due to the repeal of the 20% deduction for small business income.
  • The USA would have the highest corporate income tax rate in the developed world, higher than the United Kingdom (19 percent), China (25 percent), Canada (26.8 percent), and Ireland (12.5 percent). 
  • Taxes would rise in every state and every congressional district.
  • The Death Tax would ensnare more families and businesses.
  • The AMT would snap back to hit millions of households.
  • Millions of households would see their child tax credit cut in half.
  • Millions of households would see their standard deduction cut in half, adding to their tax complexity as they are forced to itemize their deductions and deal with the shoebox full of receipts on top of the refrigerator.

 

In Indiana, where Buttigieg is the mayor of South Bend, households who made the state average income of $55,476, received a tax cut of around $1,438.51, according to a recent Tax Foundation report.
