Many reporters covering the flavored vape issue haven't bothered to leave their desk and visit a local vape shop. This ignorance reveals itself in subtle and not-so-subtle news articles pushing to impose a national Michael Bloomberg-style ban on flavored vaping products which adults rely on to quit smoking combustible cigarettes.

So to anyone who still doesn't understand the health and electoral consequences of a flavored vape ban, watch the video below, a compilation of 15-second testimonials recorded in the past 36 hours:

Excerpts:

“Hi, my name is Jess and I'm 33 years old. I smoked cigarettes for 20 years, and I finally quit with cotton candy e-liquid. Not only do I vape but I also manage a vape shop and invested my life savings into the industry last year, so, vaping didn't just save my life, It's also my livelihood." --  Jessika Eryn

“Hello, my name is Jeremy. I'm the owner of vape works in Cumberland, Maryland. I smoked for 19 years starting at the age of 13. I switched to vaping when I found out that I was going to have my son seven years ago, I started off with a little Ego Twist and fruit flavors and I've moved on up to owning my own shops. Flavors have saved my life. And don't forget that I've vape and I vote. Thank you." -- Jeremy

“My name is Bodie, I’m 44 years old. I smoked two to two and a half packs a day of Camel Lights for 21 years. I tried Chantix, patch, gum, hippy dippy acutherapy, and cold turkey more times than I can count. Cinnamon candy flavored vapor got me to quit. Four days after I tried my first vapor, I smoked my last cigarette." -- Bodie

“I started smoking cigarettes when I was 15. Once I got into my 30s I realized I needed to quit. I tried patches, gum, pills, everything. Nothing worked until vaping. Vaping green apple e-liquid was the only thing that helped me to quit smoking cigarettes. It wasn't for vaping, I'd still be smoking." -- Candice

“Hi, this is my 15 seconds for vape. I'm 47 years old and my name is Jennifer. I quit smoking in 2010 with great mint flavored vapor. I would like the president to please save the vape shops and save flavors so they can continue to save people every day from combustible tobacco. Tobacco kills, vaping saves lives. We vape, we vote." -- Jennifer

“My name is Hannah. I'm a single issue voter. I am a mother of two middle school students and I gave up my two pack a day smoking habit with vaping flavor and nicotine e-liquids and use flavors like banana nut bread, birthday cake, and apple pie. Flavors save lives." -- Hannah

“Alright, here's my 15 seconds for vape. My name is Jacob Lindsay vape for about six years, I stopped with a flavor called summer tea. I work for Knoxville vapor and I've helped thousands. Stop smoking and switch to vapor products." -- Jacob

ATR this week also released a compilation video of local news reports showing how state-imposed vape flavor bans are devastating to communities.

"The flavor ban pushers do not understand how personal and intense this issue is to millions of adult vapers who will vote next year. As shown by our compilation of local news reports, state-imposed flavor bans are already devastating main street vape shops, their employees, and their adult customers who use flavors in order to quit smoking. These adults are a highly motivated voting block who will punish any politician that imposes a flavor ban."

One example from the video compilation is a Harrisburg, Pennsylvania news report that notes a flavor ban will "put more than 300 vape shops across Pennsylvania out of business, causing a ripple effect for employees and their communities."

In a new national poll conducted by McLaughlin & Associates, a significant number of adults that use e-cigarettes in seventeen key battleground states indicate that they will reject President Donald Trump’s re-election bid if his administration moves forward on a proposed plan to ban all flavored e-cigarettes, on that issue alone. The proposal to ban flavored vapor products is currently under consideration by the Food and Drug Administration and being championed by Health and Human Services Secretary Alex Azar.

The McLaughlin firm was a principal polling firm for Donald Trump in 2016 and remains a trusted ally for the administration. The poll was commissioned by the Vapor Technology Association. According to the pollsters

Four in five (83%) vapor consumers are likely to decide their vote based solely on a candidate’s position on nicotine vapor products and issues. Half (50%) are “very” likely to be single issue voters.

This is almost identical to the polling conducted in part by Americans for Tax Reform in October of 2016, which can be found here.

McLaughlin further concluded:

Nearly all (96%) of these vapor consumers are likely to vote in the 2020 general elections. Four in five (85%) are “definitely” voting. Among the 4% who are less likely to vote, the majority (59%) would be likely to come out to vote if lawmakers banned the sale and use nicotine vapor products.

These vapor consumers favor the Republican candidate on the generic ballot (46% to 24%), but 30% are undecided and up for grabs in the battleground states.

Supporting a ban on flavors in all nicotine vapor products is a political liability. Nearly all (96%) vapor consumers are LESS likely to vote for a candidate who supports a flavor ban. The intensity (92% much less likely) shows the passion they share on this issue.

The White House recently confirmed to the Washington Post that the “opinion of the [Trump] campaign" was that ‘banning flavored e-cigarettes might cost Trump reelection,’ an assertion published in the Washington Examiner based on an ATR analysis of likely single-issue adult vapers in key battleground states.

McLaughlin also concluded that there “is political upside for candidates who oppose a ban on flavors in all nicotine vapor products. Virtually nine in ten (88%) vapor consumers are MORE likely to vote for a candidate who opposes a flavor ban. Eight in ten (79%) are ‘much’ MORE likely to support such a candidate.”

On the flip side, if HHS Secretary Alex Azar and Acting FDA Commissioner successfully convince the White House to implement a flavor ban, McLaughlin concluded that “vapor consumers in Trump’s base would likely turn on him over this single issue.”

Although vapor consumers currently approve of the job Donald Trump is currently doing as President (51-44), 74% said that they would be less likely to vote for him, with 65% saying they would be “much less” likely to vote for Trump. Among key base and supporters, it’s significant:

  • Approve Trump: 65% less likely;
  • Republicans: 65% less likely;
  • Conservatives: 62% less likely;
  • Independent Men: 83% less likely;
  • Independent Women: 79% less likely.

Prior to e-cigarettes, 84% of respondents smoked a pack of cigarettes a day or more, with 94% reporting no longer smoking cigarettes due to nicotine vapor products. More than half smoked for at least 20 years before quitting.

“This new poll further confirms what Americans for Tax Reform has long argued, that millions of adults who use flavored nicotine e-cigarettes to quit smoking will vote on that issue and that issue alone. Banning flavors would be a significant political liability in every single one of the states that Donald Trump needs to win next year, especially in states like Michigan, Florida, Pennsylvania, and Wisconsin which have at least two million adult vapers alone,” said Paul Blair of Americans for Tax Reform.

“As McLaughlin suggests, 74% of vapers in these states voting against the President because of this issue would cost him big. McLaughlin is a trusted pollster for the President so it is our hope that this puts a stop to the FDA and HHS's misguided plans to hand Democrats a win in 2020 by banning life-saving flavored e-cigarettes. Prohibition is not a winning proposition. Instead of demonizing people who are improving their own health by transitioning to products that are 95% less harmful, the federal government should focus its attention on the true cause of recent illnesses and death: black market THC and marijuana,” said Blair.

The FDA's Michael Bloomberg-style push for a flavored e-cigarette ban disregards the importance of flavors in transitioning adult smokers away from cigarettes onto less harmful alternatives. In an analysis published in the journal Harm Reduction last year, the evidence suggests that flavored products are the overwhelming preference for adults, with tobacco and menthol ranking outside of the top five consumer preferences.

Banning flavored e-cigarettes for adults would force adult vapers to go back to smoking or to seek out products on the dangerous black market.

The poll of adult vapor voters was commissioned by the Vapor Technology Association and conducted between October 17 and 22 in Arizona, Colorado, Florida, Georgia, Iowa, Maine, Michigan, Minnesota, Nevada, New Hampshire, New Mexico, North Carolina, Ohio, Pennsylvania, Texas, Virginia, and Wisconsin. The full crosstabs can be found here.

Bernie Sanders: Warren’s Medicare for All Plan Would Have “Very Negative Impact” on Jobs and Wages

Bernie Sanders criticized Elizabeth Warren’s Medicare for All plan, noting it would have a “very negative impact” on jobs and wages.

“Senator Warren is placing what you might call an employer ‘head tax’ of $9,500 on every employer who employs more than 60 people, and that means for that employer to hire a new person would cost an additional $9,500 -- paying somebody $30--$40,000. Yeah, it’s a big chunk. I think that would probably have a very negative impact on creating those jobs or providing wages, increased wages of benefits for those workers,” Sanders said on Saturday.

Warren claims that her Medicare for All plan “doesn’t raise middle class taxes by one penny” however, a repeal of the TCJA - as she is proposing - would include a guaranteed tax increase on the middle class.

Sanders, who “wrote the damn bill,” as he likes to say, even admits that middle class taxes would go up under Medicare for All.

"Yeah, [we'd have to] raise taxes on the middle class," Sanders told a CNN reporter after the July debate.

Warren has also been the subject of fierce criticism from Joe Biden, who claims that she’s “making it up” on proposals to fund the healthcare plan.

In an interview with New Hampshire Public Radio, Warren even admitted that her plan would force around two million jobs to be lost.

Warren has continuously dodged the middle class tax question, and tried to dodge it for a total of 28 times, as Americans for Tax Reform has documented.

As the Washington Post reported, Kenneth Thorpe, chairman of the health policy department at Emory University directly said that the plan will hit the middle class. “There’s no question it hits the middle class,” he said.

Elizabeth Warren told a reporter that anyone making under one billion dollars will “not pay a penny more” in taxes after a campaign event on Saturday.

Here’s the key exchange:

CBS Reporter Zak Hudak: “Senator when you say that you won’t raise middle class taxes, what is the income bracket that you use to define middle class?”

Warren: “Here, it’s 100%. It doesn’t raise taxes on anybody but billionaires, and you know what? The billionaires can afford it and I don’t call them middle class. So, billionaire, that’s where it worked!”

Reporter: “Anyone under a billion dollars?”

Warren: “That’s right, not paying a penny more. That’s exactly right.”

In case there was any questions over what Warren actually meant, she made it crystal clear in another exchange with a Wall Street Journal reporter:

WSJ Reporter Josh Jame: "Is there a salary or income that you would define as middle class when you say 'No middle class taxes?'"

Warren: "Sure, for Medicare for All, it's a billion dollars ... no increases in taxes for anyone except billionaires, period. Done.”

Joe Biden wasted no time as his campaign said that Warren “has been lowballing the cost” of her Medicare for All plan, calling middle class tax increases “inevitable.”

“Senator Warren has spent months dodging questions about how she’d need to raise taxes on the American middle class in order to pay for her single payer health care plan, and on Friday she confirmed why: because it would,” his campaign said.

Even Bernie Sanders, who “wrote the damn bill,” as he likes to say, admits that middle class taxes would go up under Medicare for All.

"Yeah, [we'd have to] raise taxes on the middle class," Sanders told a CNN reporter after the July debate.

Warren’s “Medicare for All” Repeals Trump Tax Cuts

Elizabeth Warren’s Medicare for All plan will impose large tax increases on the middle class via a repeal of the Trump Republican tax cuts.

If Warren repealed the Trump Republican tax cuts:

-A family of four earning the median income of $73,000 would be stuck paying $2,000 more in taxes each and every year.

-A single parent with one child making $41,000 would pay $1,300 more in taxes each and every year.

 In a letter to Warren from Simon Johnson, Betsey Stevenson, and Mark Zandi wrote:

“You have identified two changes to corporate taxation that we estimate would generate $2.9 trillion in revenue between 2020 and 2029. These estimates assume the repeal of the Tax Cuts and Jobs Act of 2017 (TCJA), which you have previously proposed, and the existence of your Real Corporate Profits Tax on very large and profitable American corporations.”

Warren took that suggestion and put it in her Medicare for All plan, which was released on Friday.

“Next, we can make some basic changes to ensure that large corporations pay their fair share and to fix some fundamental problems with our current approach that actually encourage companies to shift jobs and investment overseas. These changes will generate an estimated $2.9 trillion over the next ten years,” the Warren plan says.

Warren said in a campaign video that her plan “doesn’t raise middle class taxes by one penny” however, a repeal of the TCJA would include a guaranteed tax increase on the middle class.

 However, Warren has already said that she’d use the money from reversing the Tax Cuts and Jobs Act to fund her climate plan.

The facts are, thanks to the Trump Republican tax cuts, middle class Americans received a tax cut. If you don’t believe us, just ask the New York Times, the Washington Post, CNN, and FactCheck.org:

  • CNN: “The facts are, most Americans got a tax cut.”
  • CNN: "In fact, estimates from both sides of the political spectrum show that the majority of people in the United States of America did receive a tax cut."
  • New York Times: "Most people got a tax cut."
  • Washington Post: “Most Americans received a tax cut.”
  • FactCheck.org: "Most people got some kind of tax cut in 2018 as a result of the law."
  • FactCheck.org: "The vast majority (82 percent) of middle-income earners — those with income between about $49,000 and $86,000 — received a tax cut that averaged about $1,050.
  • New York Times also noted the “sustained — and misleading — effort by liberal opponents of the law to brand it as a broad middle-class tax increase.”
  • CBS News 60 Minutes: “Trump did give the middle class a tax cut.”

Thanks to the Tax Cuts and Jobs Act:

  • A family of four earning the median income of $73,000 saw a$2,000 tax cut.
  • A single parent (with one child) making $41,000 got a $1,300 tax cut.
  • Millions of low and middle-income households are no longer stuck paying the Obamacare individual mandate tax.
  • Utility bills across all 50 states went down as a direct result of the TCJA’s corporate income tax rate reduction.
  • Small businesses saw a tax decrease because of the 20% deduction for small business income.
  • Taxes went down in every state and every congressional district.

Ballot Measure That Would’ve Killed Colorado's Taxpayer’s Bill Of Rights Goes Down In Flames

On the same Election Day that voters in Texas approved a new taxpayer safeguard in the Lone Star State, Colorado residents voted to protect their state’s Taxpayer’s Bill of Rights, the nation’s strongest taxpayer safeguard.

The Taxpayer’s Bill of Rights (TABOR), approved by Colorado voters in 1992, does two things: 1) It requires voter approval for all state tax hikes, and 2) It caps state spending at the rate of population growth plus inflation. Revenue collected in excess of that spending cap must be returned to Colorado taxpayers.

Proposition CC, which was referred to the November 2019 ballot earlier this year by the Democrat-controlled Colorado Legislature and Governor Jared Polis (D), would have permanently ended taxpayer refunds due in accordance with TABOR. Proposition CC was defeated today with nearly 56% of voters rejecting the ballot measure, which would’ve gutted TABOR forever and led to a significantly higher state tax burden in Colorado’s future.

“Presidential contenders and others running for office should pay attention to what happened in Colorado tonight,” said Grover Norquist, president of Americans for Tax Reform. “Every Democrat running president has promised massive tax increases if they win next year. A battleground state that recently elected a progressive-run state government just voted to uphold the nation’s strongest taxpayer protection measure. This indicates that a plan to run on a platform chalk full of huge tax hikes is not the wisest approach for 2020 hopefuls to take.”

Texas Voters Pass Income Tax Prohibition

The Lone Star State’s 2019 election results are in and an overwhelming majority, more than 77% of the electorate, voted to approved Proposition 4. By approving Proposition 4, Texans voted to amend the state constitution to include an income tax prohibition.

Texas is one of nine states that does not levy a state income tax. Passage of Proposition 4 inserts a new taxpayer safeguard in the state constitution ensuring that future legislatures, no matter who is in charge, cannot easily impose an income tax on Texans.

“I applaud Texas voters for putting an income tax prohibition in the state constitution,” said Grover Norquist, president of Americans for Tax Reform. “Austin and DC progressives dream of turning Texas blue and will spend a great deal of money in 2020 and beyond attempting to do so. By approving Proposition 4, Texans have installed long-term protection against well-funded progressive plans to take over the state and ultimately impose a state income tax.”

This move by Texas voters comes five years after the passage of a similar constitutional amendment in Tennessee, another no-income-tax state, back in 2014.

“The lack of an income tax has played a key role in making Texas a magnet for employers, jobs, and people,” added Norquist. “Passage of Proposition 4 ensures Texas will remain a no-income-tax state, no matter how many Californians move in.”

Vape Flavor Ban Will Devastate Main Street Businesses Nationwide

Flavor ban will decimate over 10,000 small businesses across America, causing a ripple effect for employees and their communities

A new video compilation of local news reports released by Americans for Tax Reform shows that a Trump administration imposition of the Obama administration ban on flavored vaping products would devastate main street businesses nationwide.

"The people behind this Obama-era flavor ban are about to push President Trump into traffic and walk away," said Grover Norquist, president of Americans for Tax Reform.

Another example shows a pair of hard working brothers whose ten-years-in-business shop is reeling under the "temporary" Massachusetts flavor ban:

"Ten years of hard work gone in like five minutes since the ban started. Our bank accounts are depleted. Our credit cards are maxing out. We have no cash to sustain the business anymore."

In a particularly heart-wrenching example from Rhode Island, a former smoker who started his vape shop six years ago was forced to close due to the flavor restrictions imposed by the Democrat governor. Speaking through tears, he said:

“I’ve just lost. My pride and passion gone. I called the governor four times, not even a call back. Nothing.”

Watch the video below:

  • Approve Trump: 65% less likely;
  • Republicans: 65% less likely;
  • Conservatives: 62% less likely;
  • Independent Men: 83% less likely;

Biden: Warren is "Making it Up" on How She'll Pay for Medicare For All

Joe Biden said Elizabeth Warren is "making it up" on her proposals to fund ‘Medicare for All’ during a PBS News Hour interview.

Here's the key exchange:

Reporter: "Elizabeth Warren today put out an estimate for the cost of her Medicare for All. Plan. She put it at around $20 trillion over a number of years in the past the estimate have been $34 trillion. She's talking about making it up with the difference with targeted defense spending cuts a wealth tax, cracking down on tax evaders.”

Biden: "She's making it up. Nobody thinks it's $20 trillion. It's between 30 and $40 trillion. Every major independent study that’s gone out there, that's taken a look at this — there's no way — even Bernie who talks about the need to raise middle class taxes. He can't even meet the cost of it.

Warren released her Medicare for All plan yesterday and admitted that its price tag would be an incomprehensible $52 trillion over ten years, but claimed that she will not raise middle class taxes to pay for it.

Almost immediately, the Biden campaign responded to her plan and said that it's "impossible to pay for Medicare for All without middle class tax increases."

Even Bernie Sanders, who “wrote the damn bill,” as he likes to say, admits that middle class taxes would go up under Medicare for All.

"Yeah, [we'd have to] raise taxes on the middle class," Sanders told a CNN reporter after the July debate.

Vape Ban Could Swing Election Against Trump

According to a Friday afternoon Axios scoop, "The Trump administration plans to finalize a ban on almost all flavored vaping products, with exemptions only for tobacco and menthol flavors, according to sources familiar with the plan. An announcement is expected next week."

But a poll conducted last week by Trump's campaign pollster John McLaughlin follows an ATR analysis of the number of adult vapers in battleground states like Michigan, Pennsylvania, and Florida. That analysis, based on FDA data of adult use of e-cigarettes, showed that in 12 swing states, there are more than 4.1 million adult vapers, far more than the number needed to tip the election one way or the other.

CNN Analyst on Warren: “You Can’t Just Tax the Rich to Death and Think That’s How You’re Going to Pay for Everything”

CNN Political Analyst David Gregory criticized Elizabeth Warren’s new Medicare for All plan, stating that “You can’t just tax the rich to death and think that’s how you’re going to pay for everything.”

Gregory: “I think what’s difficult here on the substantive front without looking at it in specifics is how she gets there. I think it’s fanciful to say you’re going to find money from people who avoid taxes, for example, to find your funding, or to beef up the wealth tax. You know, you just can’t tax the rich to death and think that’s how you’re going to pay for everything. I think it’s a dodge to say to folks who are middle class earners that you can have it and have it for nothing.

Warren today released her Medicare for All plan, which comes out to a mind-boggling $52 trillion over ten years.

As the Washington Post reported, Kenneth Thorpe, chairman of the health policy department at Emory University directly said that the plan will hit the middle class. “There’s no question it hits the middle class,” he said.
